1. Acceptance of Terms

By accessing or using KeyMorphX (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and archITex Solutions GmbH ("we," "us," or "our").

2. Service Description

KeyMorphX is a keyboard application that allows users to transform text input from any app into over 100 different styles, such as pirate speak, Shakespearean language, and more. While there is no specific usage limit, we enforce a Fair Use Policy to ensure the quality and availability of the Service for all users. We reserve the right to block or limit usage at any time if we deem it necessary.

3. Account Registration

  • Eligibility: Our Service is intended for users of all ages. However, if you are under the age of consent in your country, you should review these Terms with your parent or guardian.
  • Registration: Users are required to register an account using an email address or a Google Account. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account.
  • Account Security: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Fair Use Policy

We monitor usage to prevent misuse and ensure fair access for all users. Prohibited behaviors include, but are not limited to:

  • Excessive use that negatively impacts the Service's performance.
  • Automated scripts or bots that interact with the Service.
  • Any form of data mining or extraction.

Violations of the Fair Use Policy may result in temporary or permanent suspension of your account. By using the Service, you acknowledge that we may monitor usage patterns, including the frequency of certain features, to ensure compliance with this Fair Use Policy. This monitoring is conducted in accordance with our Privacy Policy and applicable privacy laws.

5. Prohibited Activities

You agree not to engage in the following activities:

  • Unlawful Use: Using the Service for any illegal purposes or in violation of any local, national, or international law.
  • Reverse Engineering: Attempting to decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Service.
  • Interference: Interfering with, disrupting, or creating an undue burden on the Service or the networks connected to the Service.
  • Unauthorized Access: Attempting to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.
  • Automated Access: Using any automated system, including "robots," "spiders," or "offline readers," to access the Service.

6. In-App Purchases

  • Payments: All in-app purchases are processed through authorized payment processors like Google Play Store. By making a purchase, you agree to the terms and conditions of the respective payment processor.
  • Refunds: All sales are final. Refunds are issued only where required by law.
  • Pricing: Prices for in-app purchases are subject to change without notice.
  • Refunds for Service Termination: If the Service is terminated or discontinued, no refunds will be provided for any in-app purchases or subscriptions already made.

7. Account Termination

  • Termination by You: You may terminate your account at any time by contacting us at office@architex.solutions or via the contact form at our website.
  • Termination by Us: We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms, our Fair Use Policy, or is harmful to other users or us.

8. Intellectual Property Rights

All content, features, and functionality of the Service (including but not limited to text, graphics, logos, and software) are the exclusive property of archITex Solutions GmbH and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Use of Open-Source Software

Our Service includes open-source software licensed under the Apache License 2.0. By using our Service, you agree to comply with the terms of the Apache License.

10. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by us. We use third-party services such as Google Cloud, Firebase, and Umami to operate and improve our Service.

  • Disclaimer: We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

We rely on third-party providers, such as Google Cloud and Firebase, for the operation of the Service. We disclaim all liability for disruptions, data loss, or other issues caused by third-party services. Users agree to comply with the terms of these third-party providers and acknowledge that their availability may affect the Service.

11. Warranty Disclaimer

  • Service Availability: We strive to provide a reliable Service with minimal downtime. However, we do not guarantee 100% uptime and offer no Service Level Agreement (SLA).
  • "As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
  • No Warranty: We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and availability.

12. Limitation of Liability

To the maximum extent permitted by law, in no event shall archITex Solutions GmbH, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content.

13. Indemnification

You agree to indemnify, defend, and hold harmless archITex Solutions GmbH and its affiliates, officers, agents, employees, and partners from any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of your use of the Service or your violation of these Terms.

14. Dispute Resolution

  • Governing Law: These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions.
  • Jurisdiction: Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Lower Austria.
  • Arbitration: At our sole discretion, we may require you to submit any disputes to final and binding arbitration.
  • International Users: If you access the Service from a jurisdiction outside Austria, you agree that Austrian law applies to these Terms and the use of the Service. You are responsible for compliance with all applicable local laws.

15. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

16. Service Termination by Us

We reserve the right to modify, suspend, or permanently discontinue the Service (or any part thereof) at any time, for any reason, including but not limited to situations where the continuation of the Service is no longer feasible. In the event of termination, users will be notified at least 30 days in advance, where possible. By accepting these Terms, you acknowledge and agree that archITex Solutions GmbH shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Updates and Notifications

We may update these Terms from time to time. If we make significant changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the new Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to reflect the parties' intention, and all remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and archITex Solutions GmbH regarding the Service and supersede any prior agreements.
